Welcome to Automedis. These Terms of Service ("Terms") govern your access to and use of the Automedis mobile application ("App") and related services ("Service") provided by Automedis ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Automedis is a car listing monitoring and aggregation service. We collect and display publicly available car listings from third-party websites and portals, including but not limited to mobile.de, otomoto.pl, autoplius.lt, and autogidas.lt. We provide tools for users to create search filters, receive notifications about new listings, and view listing details.
Automedis is an information service only. We do not sell, buy, broker, or facilitate the sale or purchase of any vehicles. We do not participate in any transactions between buyers and sellers. Any communication or transaction between you and a vehicle seller is solely between you and that seller.
Listing data is sourced from third-party portals and websites. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any listing data displayed through the Service. Listings may contain errors, may be outdated, or may have been removed from the original source.
We are not responsible for the content, accuracy, or legality of any listing data originating from third-party portals. The original listing portals retain all rights and responsibility for their content.
To use the Service, you must create an account by providing a valid email address and password, or by authenticating through a supported third-party provider (e.g., Google or Facebook). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must provide accurate and complete information when creating your account. You must be at least 16 years of age to create an account and use the Service.
Automedis offers a free tier and paid options. You can purchase credit packs for pay-per-scrape usage, or subscribe to a per-filter monthly subscription for unlimited scrapes on individual filters.
On Android, credit packs are purchased through Google Play Billing. Per-filter subscriptions are billed on a recurring monthly basis. You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period.
We reserve the right to modify pricing at any time, with reasonable advance notice to existing subscribers.
Credits are digital content delivered to your account immediately upon purchase. By buying credits you expressly consent to immediate delivery and acknowledge that you thereby lose the 14-day right of withdrawal available for distance purchases in the EU. All sales are final and credits are non-refundable, except where a refund is required by applicable law (for example, content that is faulty or not as described) or where Google issues a refund under Google Play policies. Where Google refunds a purchase, the corresponding credits are removed from your balance.
You agree not to use the Service for any unlawful, abusive, or prohibited purpose. Specifically, you must not:
The Automedis application, including its design, code, user interface, logos, and trademarks, is the intellectual property of Automedis and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.
Listing data displayed within the Service belongs to the respective third-party portals and sellers. We do not claim ownership of third-party listing content.
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. If we discontinue a paid service, we will provide reasonable notice and, where applicable, a pro-rata refund.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Automedis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Service. We are not liable for any decisions made based on listing data provided through the Service, including but not limited to vehicle purchase decisions.
Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
We may suspend or terminate your account at our sole discretion if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that could harm other users or the Service itself. Upon termination, your right to access the Service will immediately cease.
You may delete your account at any time through the App settings. Upon account deletion, your personal data will be removed in accordance with our Privacy Policy.
You agree to indemnify, defend, and hold harmless Automedis, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Lithuania.
We reserve the right to update or modify these Terms at any time. If we make material changes, we will notify you through the App or by email. Your continued use of the Service after such notification constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and delete your account.
